  • Fulfillment and Responding to Requests. We may use personal information to fulfill requests and perform our responsibilities under our contract with you, such as opening your account.

  • Protection and Security. We may use personal information to protect the security and integrity of our Services, and for the protection of Huxley, our users, and others.

  • Responding to your inquiries. We may use personal information to respond to questions.

  • We may use financial information to complete requested transactions.

  • Administrative Communications. We may use personal information to send important information regarding our Services, such as changes to our terms, conditions, and policies and/or other administrative information. Because this information may be important to us providing our Services, you may not opt-out of receiving such communications.

  • Marketing Communications.We may use personal information you or third parties provide to better understand your needs and preferences and show you more meaningful content based on your interests (including to notify you of Huxley Products and Services, sales and promotions, or other matters that may be of interest to you). You may, at any time, stop email marketing communications from Huxley by clicking on the “unsubscribe” link contained in every email communication that Huxley sends to you. Following this, you may still receive administrative communications (such as receipts for Product orders), and critical messages related to your account (such as password reset requests that you initiate).

  • Mailing Lists. We may send you information on Products, Services, special deals, newsletters and other materials from Huxley. If you no longer wish to receive such materials from Huxley, you may opt-out of receiving these communications by emailing us at accounts@Skybound.com. However, please note that even if you opt-out, you may receive Site and Service announcement updates, which are distributed to members automatically in connection with our provision of Services.

  • Forums, Blogs, Message Boards. If you register for access to any of our blogs or message boards, we will use your personal information to enable you to view and post messages on the boards. However, you should understand that community forums, blogs, and message boards are tools that allow you to communicate with members of the online community. As such, whenever you give out personal information in public areas, that information can be collected and used by others. We are not responsible for any personal information you provide publicly or to third parties.

  • When you use certain Services of ours, such as our games or mobile apps, we may request your consent to collect information about your actual location in order to provide location-based services. We may use various technologies to determine your location, including Wi-Fi triangulation, Bluetooth Low Energy, GPS, IP address, and other sensors.

  • Affiliated Entities. We may share personal information to our subsidiaries and company affiliates. These companies may use your information consistent with this Privacy Policy.

Also, in the event that Huxley or substantially all of its assets are acquired, your customer information will be one of the transferred assets. If we purchase a business, the personal information received with that business would be treated in accordance with our Privacy Policy in effect at that time, so long as it is practicable and permissible to do so. If we sell a business, we will include provisions in the selling contract requiring the purchaser to treat your personal information in the same manner required by our Privacy Policy in effect at that time. The provisions of this paragraph will apply also if we are sold as a part of bankruptcy proceedings.

Additionally, if you enter a contest, sweepstakes or other promotion, the official rules may include other provisions related to the sharing of your personal information.

Usage. Huxley and its third-party service providers use cookies, web beacons, and similar tracking technologies to recognize you when you visit our Website, remember your preferences, and give you a personalized experience. When you visit our Website, we, or an authorized third party, may place a Cookie on your device that collects information, including Personal Data, about your online activities over time and across different sites. Persistence. We use both session-based and persistent Cookies on our Website. Third Parties. Third Parties may collect additional information from you. While we are dedicated to securing our Website and Services, you are responsible for securing and maintaining the privacy of your passwords and account information. We are not responsible for protecting Personal Data shared with a Third Party based on a connection that you have authorized.

  1. We do not control third parties' collection or use of your information to serve interest-based advertising. However these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative ("NAI") on the NAI's website.

  1. Promotional Offers from the Company. If you do not wish to have your Contact Information used by the Company to promote our own or third parties' Services, you can opt-out by sending us an email stating your request to huxleysaga@gmail.com. If we have sent you a promotional email, you may send us a return email asking to be omitted from future email distributions.

  2. Data Subject’s Rights. Depending on where you reside, you may have data subject rights as set forth based on location of residency below.

a.      UK/UE/EEA Data Subject Rights under the General Data Protection Regulation (GDPR). If you are a resident of the United Kingdom, European Union, or European Economic Area (EEA), you may have certain data protection rights. We aim to take reasonable steps to allow you to correct, amend, delete, object to the processing, restrict the processing, request a transfer, or limit the use of your Personal Information. You can exercise rights over your Personal Data against the Controller by submitting a request by emailing us at huxleysaga@gmail.com, with the subject line “GDPR Data Subject Request”. When collection is based on your consent, you have the right to withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal by applicable law. If applicable by national law, you have the right to lodge a complaint with a supervisory authority if you believe that the processing of your personal data relating infringes your rights.

b.   California Consumer Privacy Act. If you are a California resident, or were within the last year or at any point since January 1, 2022, you have the following rights under applicable California law in relation to your Personal Information, subject to certain exceptions: 

 i.         Right to Know. You have the right to, up to twice in a 12-month period, request what Personal Information we collect, use, disclose, share, and/or sell, as applicable.

 ii.         Right to Delete. You have the right to request the deletion of your Personal Information that is collected by us.

 iii.         Right to Opt-Out of Sale. You have the right to opt-out of the sale of your Personal Information by a business. However, as noted above, we do not currently sell any Personal Information.

 iv.         Right to Non-Discrimination. You have the right not to receive discriminatory treatment for the exercise of the privacy rights described above.

 v.         Right to Correct. You have the right to correct inaccurate Personal Information that we maintain about you.        

 vi.         Right Not to Be Discriminated Against. You have the right not to receive discriminatory treatment by us for exercising your privacy rights, including the right not to be retaliated against.

We may sell or share (in the context of cross-behavioral advertising which means the targeting of advertising to a consumer based on the consumer’s personal information obtained from the consumer’s activity across businesses including distinctly-branded websites, applications, or services) Personal Information. If we do, you will be notified of it prior to or at the point of such collection for those purposes, and provided a link to opt-out of the selling/sharing of Personal Information.

These rights are not absolute, and there may be cases when we decline your request as permitted by law.

Any request you submit to us is subject to an identification and residency verification process as permitted by the CCPA.

To submit a request pursuant to this Section, please contact us, or have your authorized representative, contact us at huxleysaga@gmail.com, with the subject line “California Data Subject Request”. In the event you have an authorized representative submit a request to delete, request to correct or request to know on your behalf, you will have to provide written authorization demonstrating this grant of authority, which can include a Power of Attorney. Authorized representatives may not submit any other types of requests on your behalf.

For purposes of requests to delete, correct and to know, we will verify your identity based on information we have collected about you, including your name, address, and phone number, but will not fulfill your request unless you have provided sufficient information that enables us to reasonably verify that you are the consumer about whom we collected the Personal Information. If we are unable to verify your identity, we may deny your request.

c.   If you are 16 years of age or older, you have the right to direct us not to sell your Personal Information at any time. We do not and will not sell Personal Information of consumers we actually know are less than 16 years of age unless we received affirmative authorization from the consumer who is between 13 and 16 years of age, or the parent or guardian of a consumer less than 13 years of age, to opt-in to the sale of their Personal Information. Upon the receipt of this request to opt-in, we will inform the minor of the right to opt-out later and of the process for doing so.

d.   We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

DO NOT TRACK

Do Not Track is a privacy preference that Visitors can set in their web browsers. When a Visitor turns on the Do Not Track signal, the browser sends a message to websites requesting them not to track the Visitor. At this time, we do not respond to web browser “do not track” settings or signals.
